1. Acceptance of Terms
By accessing or using Smart Menu, you agree to be bound by these Terms and Conditions and our Privacy Policy. If you do not agree, please do not use our app.
2. Description of Service
Smart Menu provides a digital menu, ordering, and table management platform to enhance your dining experience. Features include:
- Browsing menus via QR codes
- Placing orders digitally
- Managing table reservations
- Logging in securely with Facebook Login or other supported methods
3. User Accounts and Login
- You may create an account using Facebook Login or email.
- You are responsible for maintaining the confidentiality of your login credentials.
- You agree to provide accurate, current, and complete information during registration and to update it when necessary.
- You must be at least 13 years old to use Smart Menu. If under 18, you must have parental or guardian consent.
4. User Conduct and Responsibilities
You agree that you will not:
- Use Smart Menu for any unlawful or fraudulent purposes.
- Interfere with or disrupt the app’s operation, servers, or networks.
- Attempt to gain unauthorized access to any part of Smart Menu.
- Use automated means to access or collect data from the app without permission.
- Post, upload, or transmit content that is offensive, harmful, defamatory, infringing, or otherwise objectionable.
- Violate any applicable laws or regulations while using the app.
5. Orders, Payments, and Restaurant Relations
- Orders placed via Smart Menu are contracts directly between you and the restaurant.
- Smart Menu facilitates order placement but does not guarantee fulfillment, quality, or pricing.
- Payment processing is handled through third-party providers and subject to their terms.
- Refunds, cancellations, or disputes regarding orders must be handled with the restaurant.
6. Facebook Login
- Using Facebook Login allows Smart Menu to access certain information from your Facebook account as described in our Privacy Policy.
- We do not store or share your Facebook password.
- You can revoke app permissions through your Facebook account settings at any time.
7. Intellectual Property
- All intellectual property rights in Smart Menu’s content, design, software, and trademarks belong to Smart Menu or its licensors.
- You may not copy, reproduce, distribute, create derivative works, or use any part of the app’s content without prior written permission.
8. Third-Party Services and Links
- Smart Menu may contain links to third-party websites, services, or apps (including payment gateways, social media platforms, or restaurant websites).
- We do not control or endorse these third parties and are not responsible for their content, policies, or practices.
- Your use of third-party services is at your own risk and subject to their terms.
9. Limitation of Liability
- Smart Menu is provided “as is” and “as available” without warranties of any kind, either express or implied.
- We disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
- We are not liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use or inability to use the app.
- We do not guarantee uninterrupted or error-free service.
10. Indemnification
You agree to indemnify, defend, and hold harmless Smart Menu, its affiliates, officers, employees, and agents from any claims, damages, liabilities, costs, or expenses arising from:
- Your use of the app.
- Violation of these Terms.
- Violation of any third-party rights or laws.
- Your submitted content or communications.
11. Termination
- We reserve the right to suspend or terminate your access to Smart Menu without notice for violation of these Terms or any suspicious activity.
- Upon termination, your rights to use the app will immediately cease.
12. Dispute Resolution
- Any disputes arising from or related to these Terms or your use of Smart Menu shall first be attempted to be resolved through informal negotiation.
